Terms of Use

The Users use of the website is governed by the Terms of Use Agreement, privacy policy, disclaimer and any other relevant terms and conditions, policies and notices which apply to the website or a specific section or module of the website. By using the website the user is agreeing to the terms of use. To continue use of the website in accordance with these terms please tick the acknowledgment box.

1. Aged Care Gurus Pty Ltd (“Aged Care Gurus”) is the sole owner of the copyright of the product and the user may not claim any intellectual or exclusive ownership to any of Aged Care Gurus’ products.
2. The user may not offer any of Aged Care Gurus’ products whether modified or not for redistribution or resale of any kind without prior written consent of Aged Care Gurus.
3. Aged Care Gurus reserves the right to change the terms of use at any time. Such changes will become effective and binding after they have been posted on Aged Care Gurus’ website. It is the user’s responsibility to review the product’s terms of use on a regular basis and be aware of any changes made. By continuing to use the Software and product after any revision has been made and posted, the user agrees to abide by the amended Terms of Use.
4. The product provided by Aged Care Gurus is provided on an “as is” and “as available” basis and are used at the user’s own risk. No warranties related to the product are made, including, but not limited to, warranties of merchantability or fitness for a particular purpose. Aged Care Gurus makes no warranties that its services will not be interrupted or will be error free. Aged Care Gurus does not guarantee that any specific results will be achieved by using its product. No piece of advice or information, written or oral, given by Aged Care Gurus, its employees or agents may be viewed as a warranty of any kind. In no event shall Aged Care Gurus be held liable for any damages including, but not limited to, direct, indirect, incidental or consequential damages or other losses arising out of the use of or the inability to use the product.
5. Although information has been compiled in good faith to provide information for the user, Aged Care Gurus, its parents, subsidiaries, affiliates or employees shall not be liable of any damages for any kind whatsoever including, without limitation, direct, indirect, special, consequential or incidental damages resulting from or in connection with the use of the product or resulting from or in connection with any materials, information, opinions or recommendations contained within the product. Aged Care Gurus may at any time make modifications, improvements and/or changes to the Terms of Use and Software License Agreement, the information, names and calculations within the product or the product and services referred to in the product without notice. The product may contain references to things, matters which are not under its control. Aged Care Gurus shall have no responsibility whatsoever for the contents of any such references.
6. The name of Aged Care Gurus who is the copyright holder of the product may not be used in advertising or publicity pertaining to the product without the specific prior permission of Aged Care Gurus. Title to copyright in the product and any associated documentation will at all times remain with Aged Care Gurus.
7. Aged Care Gurus shall not be held liable for delays in information delivery, loss or destruction of information or other damages experienced by users of the product. Aged Care Gurus shall not be liable as a result of updating, adding, changing and/or deleting in part or in whole the contents including the suspension or cessation of the product.

User’s acknowledgement

9. All information and reports contained and presented within the product is supplied and entered by the user who warrants same to be accurate and reliable. Aged Care Gurus does not guarantee its accuracy and the user is responsible for accuracy of such information.
10. The user and the third parties are responsible for making their own decision about the accuracy, reliability and the correctness of the information contained within the product. For this purpose the user warrants and shall ensure that each user waives and releases Aged Care Gurus to the full extent permitted by law from any and all claims relating to the usage of the product or information contained therein. Aged Care Gurus does not accept any liability for any injury, loss or damage incurred by reliance on the information provided in the product or incorporated into the product by reference.

Indemnity

11. The user covenants with Aged Care Gurus that in relation to these terms of use and the product and services supplied by Aged Care Gurus that the user will indemnify Aged Care Gurus, its parents subsidiaries, affiliates and employees against all losses, damages or expenses sustained by Aged Care Gurus after the date of this agreement arising out of any claim or demand made by any party for damages for breach of contract or tort or by reason of some other act or omission on the part of Aged Care Gurus and the amount of all costs and expenses incurred by Aged Care Gurus in contesting any such claim or in defending any action or proceeding in respect of any such claim or demand. Aged Care Gurus does not accept any liability for any injury, loss or damage incurred by reliance on the information provided in the product or incorporated into the product by reference.

No Warranty

12. Aged Care Gurus provides absolutely no guarantee or warranty for completeness, accuracy, timeliness, appropriateness, credibility, suitability, usefulness, commercial value, non-violation of intellectual property rights, execution of obligations by third parties, misinformation or product services or rights provided by the user or a third party.

Users Responsibility

13. Users of the product shall bear the liability of whether or not to trust the content provided through the product and whether or not to act on such information. Aged Care Gurus shall bear absolutely no liability for the results of any and all conduct by users based on the use and or referencing of the content of the product. Additionally, any complaint, claims or disputes involving the contents of the product shall be resolved between the user and third party concerned and Aged Care Gurus shall have no involvement in the matter whatsoever.

Exclusion of Moratorium Legislation

14. All Moratorium Legislation and regulations which may now or hereafter be in force and all relief and protection conferred thereby, thereunder so far as same can be and are hereby expressly excluded waived and negatived.

Severability

15. In the event that any one or more of the provisions of these terms of use shall be invalid, void, illegal or unenforceable in respect of any law and the validity existence legality and enforceability of the remaining provisions hereof shall not in any way be affected prejudiced or impaired thereby.

Proper Law

16. These terms of use shall be governed by and construed in accordance with the law for the time being enforced in Victoria, Australia and the user submits to the jurisdiction of the Courts of Victoria in respect of all matters arising hereunder or relating thereto.
